Rejected petition Create a recall and by-election mechanism for any Members of the Senedd.

There is currently only a recall and by-election process in the Westminster parliament. No such process exists in the Senedd, Scottish Parliament or Northern Ireland Assembly therefore constituents cannot recall their elected representative to account. This is unfair and undermines democracy.

The Government of Wales Act 2006 as amended by the Wales Act 2017 sets out some disqualification criteria but does not allow for constituency recall. Currently The Commissioner for Standards handles complaints against individual members of the Senedd. This is not robust enough and a petition process for constituents needs to be introduced. It needs to exceed the criteria as laid down by the Westminster Recall of MP’s Act 2015 and be triggered by constituents on any matter of Senedd process or policy. The triggering of any recall, has to be to a threshold % of eligible petitioning constituents. The Westminster Recall Act allows for 10% of constituents petitioning for a recall and by-election.

Why was this petition rejected?

There’s already a petition about this issue. We cannot accept a new petition when we already have one about a very similar issue, or if the Petitions Committee has considered one in the last year.
